Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Teradive (the "Service") at teradive.com. The Service is operated by Locupix, LLC, a limited liability company organized under the laws of the State of Delaware and headquartered in Houston, Texas, United States ("Locupix," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Teradive is a privacy-conscious site analytics tool. You install a small JavaScript snippet on a website you control; the Service records page visits and shows you aggregate statistics (visit counts, geography, referrers, browser info, and similar) on a dashboard.
2. Experimental status and pricing
Teradive is currently an experimental, beta-stage Service. It is provided free of charge while in this stage. Because it is experimental, features may change, break, or be removed; expect occasional disruption and treat the dashboard's analytics as best-effort rather than authoritative.
We may introduce paid plans in the future to support continued development of the Service. If we do, a free tier will always remain available, although it may carry usage limits (for example on the number of sites, the volume of visits collected, or the retention period of historical data). Any new pricing or limits will be announced before they take effect, and applied prospectively rather than retroactively to past usage.
3. Accounts
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for everything that happens under your account. Notify us promptly if you believe your account has been compromised.
4. Email communications
We send two kinds of email. Account-required messages (email-address confirmation, password resets, security notices, billing notices if any) always go out regardless of your preferences — without them the Service can't function for you. Product emails include things like setup reminders if your account hasn't recorded any traffic yet, beta announcements, and occasional update notes.
Product emails are opt-in by default when you create an account. You can turn them off any time from your account settings page; we'll stop sending them within a reasonable period after you change the preference. We do not sell or rent your email address.
5. Acceptable use
You agree that you will not, and will not allow others on your behalf to:
- install the tracking snippet on a website you do not own or are not authorized to instrument;
- use the Service to collect personally identifiable information (PII), special-category data, or any data about visitors that you are not legally permitted to collect in the jurisdictions where they reside;
- use the Service in violation of any applicable law, including privacy and data-protection laws (such as GDPR, CCPA, or equivalent);
- attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its underlying infrastructure;
- resell, sublicense, or commercially redistribute the Service or its data without prior written permission;
- use the Service to track behavior of children under the age at which parental consent is required in their jurisdiction.
You are responsible for posting any notices, banners, or consent flows that the law of your visitors' jurisdictions requires for analytics tracking.
6. Data we collect via the tracker
The tracking snippet sends the following to the Service when a visitor loads an instrumented page: page URL, referrer, user-agent string, browser language, screen dimensions, an opaque visitor ID stored in the visitor's browser, and the IP address used to make the request (used at receipt time to derive coarse geography and the network operator, then stored alongside the request). We do not collect form input, click tracking, keystrokes, full session replays, or other content-level data.
7. Your data
You own the data collected from your sites through the Service. We process it on your behalf so we can show you analytics. We do not sell your data, and we do not use it to profile your visitors for advertising or to train models. You may export your data at any time as CSV or via the API, and you may delete a site (and its data) from your dashboard.
8. Account deletion and data retention
You may delete sites at any time. Deleting a site removes its database record and the associated logs from the Service. We may keep operational backups for a limited period for disaster-recovery purposes. If you delete your account, we will delete or anonymize your personal information within a reasonable period unless retention is required by law.
9. Service availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any data will be preserved without loss. We may change, suspend, or discontinue any part of the Service at any time, and will give reasonable notice when we can.
10. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided without warranty of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Locupix, LLC or its members, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of (or inability to use) the Service.
Our total cumulative liability arising out of or relating to these Terms or the Service is limited to the amount of fees you have actually paid us for the Service in the twelve months preceding the event giving rise to the claim. Because the Service is currently provided free of charge, our aggregate liability to free-tier users is limited to zero. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the foregoing limitations apply to the fullest extent permitted by law.
12. Indemnity
You agree to defend and indemnify Locupix, LLC and its members, employees, and contractors against claims, damages, and expenses arising out of or related to your use of the Service in violation of these Terms or applicable law, including claims that your tracking implementation violated the rights of visitors to your sites.
13. Termination
You may stop using the Service at any time by deleting your sites and account. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. The provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnity) will survive.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated by email to the address on your account or by a notice on the dashboard. Continued use of the Service after changes take effect means you accept the revised Terms.
15. Governing law and venue
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
